Simple and Fair Terms



 

1. GRANT OF RIGHTS

The Artist hereby grants the Client an exclusive, perpetual, and worldwide license to use the artwork for the specific purposes of promoting and representing the project. 

2.
PERMITTED USAGE

This license covers all standard promotional and commercial materials typical for your specific type of project. 
If you need the product/s specified then we can add that into a contract for your records after purchase.

3. RESTRICTIONS

The Client is strictly prohibited from:

Sublicensing: The Client may not lease or license the Art to any third-party entity.

Resale of Art: The Client may not sell the Art as a standalone product (e.g., selling the digital file to another band, company, or stock site).

Third-Party Profit: The Art may not be used by third-party brands for non-band/company-related products without the Artist's written consent.

Royalties
(Small projects ignore this part)
I request a 5% royalty fee from profits after the first $10k usd earned, meaning $500 per 10k earned from products using my art up until the point that the art is no longer used to generate revenue.

This request is from the specific types of businesses listed below.

1. Top tier bands or influencers with millions of fans and/or followers.


2. High-Volume Retailers that move massive amounts of inventory directly to consumers.

3. Wholesalers that buy large quantities of goods from manufacturers and sells them in "bulk" to other businesses or retailers rather than to individual shoppers.

4. Big-Box Retail Stores (e.g., Target or Costco).

Why You’re Making the right Choice 

When you buy design from Mark Cooper Art, you're getting a signature style that stands out from other artists, made by someone with over 20 years of experience. Not some slop that looks like it could have been drawn by anyone, especially with all of the ai garbage flooding the internet.

There's a lot of fake artists out there these days. Be sure to check an artists history before you buy from them. If they haven't been around for a decade or longer(before ai), you need to see early work that wasn't up to par. Artists don't instantly come onto the market with pro level work. It takes many years to become that skilled. That's the only viable way to know for sure if you can't tell by looking. If the artist doesn't show development over time, or you see a huge jump from beginner to pro, that's not their work.
